Product Purchase – Sale Terms and Conditions

1. GENERAL PROVISIONS

These Product Purchase – Sale Terms and Conditions, together with other documents referred to herein (hereinafter – the “Terms”), constitute a binding legal document for the Parties, establishing the rights, obligations, and liabilities of the Buyer and the Seller when purchasing goods from the online store www.somanta.eu (hereinafter – the “Online Store”).

The Seller undertakes to transfer the goods to the Buyer in accordance with these Terms, while the Buyer undertakes to accept the ordered goods and pay for them as established herein.

By using the Online Store, placing orders, and creating an account, you confirm that you have read these Terms, understand the rights and obligations set forth herein, and agree to comply with them unconditionally and irrevocably.

If the Buyer does not agree with all obligations set out in these Terms, the Buyer has no right to use the Online Store, register an account, or purchase goods.

Definitions

  • Terms – these rules governing the use of the Online Store and the purchase-sale of goods.
  • Goods – products offered or sold through the Online Store.
  • Seller – MB “Ecolume”, company code 307629803, Girulių g. 10, LT-12112 Vilnius, Lithuania.
  • Buyer – a natural person purchasing goods for personal (consumer) use.
  • Account – the Buyer’s personal account created upon registration.
  • Personal Data – any information relating to an identified or identifiable natural person under GDPR.
  • Parties – the Seller and the Buyer.

The purchase-sale agreement is deemed concluded once the Buyer forms a shopping cart, provides delivery details, selects a payment method, confirms agreement with the Terms, and completes payment.

The Seller processes Personal Data in accordance with the Privacy Policy.

The Seller reserves the right to amend these Terms at any time. Changes become effective once published in the Online Store.

2. GOODS, PRICING, PAYMENT, AND DELIVERY

All information regarding products, pricing, and warranties is provided in the product descriptions in the Online Store.

Product images are illustrative only. Actual appearance, colors, dimensions, packaging, and other features may differ.

Prices are indicated in Euros and include VAT and applicable taxes.

Payment methods:

  • Electronic banking
  • Payment card
  • Other methods indicated in the Online Store

The Seller confirms the order after successful payment.

The Seller may cancel orders in exceptional cases, including:

  • Technical system errors
  • Pricing mistakes
  • Unavailable products
  • Discontinued products
  • Significant delivery delays

Invoices may be provided electronically.

Delivery methods:

  • Parcel locker delivery
  • Courier home delivery

The Buyer must provide an accurate delivery address.

The Buyer must inspect the shipment upon delivery and report visible damage immediately.

Risk of loss transfers to the Buyer upon delivery.

If the Buyer fails to collect paid goods, the order may be cancelled and refunded minus delivery/banking fees.

3. ORDERING GOODS AND CONCLUSION OF CONTRACT

The purchase-sale contract becomes effective after:

  1. Order placement
  2. Acceptance of Terms
  3. Successful payment

Unpaid orders are automatically cancelled after 24 hours.

Orders are stored in the Online Store database and accessible in the Buyer’s account.

Confirmed orders cannot usually be modified or cancelled because they are prepared immediately for shipment.

4. PRODUCT QUALITY GUARANTEE

The Seller guarantees that goods:

  • Match their descriptions
  • Are suitable for normal use
  • Meet standard quality expectations

The Seller is not responsible for visual discrepancies caused by the Buyer’s display device.

Consumer rights under Lithuanian law remain unaffected.

5. RIGHTS AND OBLIGATIONS OF THE PARTIES

Buyer obligations:

  • Provide accurate personal information
  • Use the Online Store lawfully
  • Protect login credentials
  • Pay for ordered goods
  • Inspect goods before use

Seller obligations:

  • Ensure proper operation of the Online Store
  • Protect Buyer personal data
  • Provide services in accordance with these Terms

The Seller may suspend Buyer access if:

  • Terms are violated
  • Illegal actions occur
  • Maintenance is required
  • Buyer actions threaten the Seller or third parties

6. RETURNS, EXCHANGES, AND WITHDRAWAL

The Buyer may withdraw from the contract within 14 calendar days without providing a reason.

Returned goods must:

  • Be unused
  • Be in original packaging
  • Include all accessories and labels
  • Retain commercial appearance

Returns are not accepted for:

  • Customized goods
  • Opened hygiene products
  • Goods inseparably mixed with others

The Buyer bears return shipping costs.

Refunds are processed within 14 calendar days after receipt and inspection of returned goods.

If goods are defective, the Buyer may request:

  • Repair
  • Price reduction
  • Replacement
  • Refund
  • Contract termination

7. LIABILITY

The Seller is liable only for damages caused intentionally.

The Buyer is responsible for:

  • Accuracy of provided data
  • Unlawful actions performed using the Online Store

The Seller is not liable for disruptions caused by third parties or force majeure circumstances.

8. FINAL PROVISIONS

Communication between Parties may occur electronically and shall be considered legally valid.

Disputes are resolved through negotiations. If unresolved within 14 days, disputes are settled according to Lithuanian law.
